Josh focuses his practice on Section 337 investigations before the United States International Trade Commission (ITC).

Josh represents clients in Section 337 investigations involving patents and trade secrets across a broad range of technologies, including electronic displays, smartphones, networking routers, LED lighting devices, storage drives, lithium-ion batteries, orthodontics devices, and sporting equipment.

Josh has significant experience litigating in the ITC, where he has represented clients in eighteen Section 337 investigations. Josh’s experience in Section 337 investigations spans from inception through appeal, including due diligence, complaint drafting, discovery management, motions practice, complex discovery issues management, subpoena enforcement in foreign jurisdictions, depositions, and pre-and post-trial activities.

Having focused almost exclusively on Section 337 investigations, Josh is well-versed in navigating the rigorous, fast-paced nature of these proceedings, including the many ITC procedural nuances that are unique to the forum, such as the domestic industry and importation requirements. Josh’s experience representing complainants, respondents, and third parties allows him to have a comprehensive view of the issues at play in an investigation and formulate strategies accordingly. Further, Chambers USA has recognized Josh among the nation’s top Section 337 practicioners in 2021 and 2022.

Before joining Fabricant LLP, Josh was an associate at Nixon Peabody LLP and part of the firm’s Section 337 team. Prior to Nixon Peabody LLP, Josh was an associate at Adduci, Mastriani and Schaumberg LLP.
